WPI 70.04 DUTY OF FOLLOWING DRIVER

A statute provides that a driver shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of the vehicles and the traffic upon and the condition of the street or highway.

When one vehicle is following another vehicle, the primary duty of avoiding a collision rests upon the following driver. The following driver is negligent if his or her vehicle runs into the car ahead, in the absence of an emergency. The following driver is not necessarily excused, even in the event of an emergency. It is the duty of the following driver to keep such distance and maintain such observation of the car ahead as may be required by reasonably foreseeable traffic conditions to make an emergency stop.
