RCW 46.61.667 USING A WIRELESS COMMUNICATIONS DEVICE WHILE DRIVING
A person who drives a motor vehicle while holding a cell phone or other wireless communications device to his or her ear is guilty of a traffic infraction. The purpose of this law is to phase out the use of hand-held cell phones by motorists while driving.
Exceptions include:
Hands free mode includes using a speaker phone, headset or earpiece.
This law supersedes any local laws, ordinances or regulations.
Enforcement of this law can only be as a secondary offense for which a driver is stopped for.
Infractions of this law will not become part of the driver's record and reported to insurance companies or employers.
