Sidewalk and Crosswalk Accidents

Legal Assistance for People Seriously Injured in Washington Pedestrian and Crosswalk Accidents

If you or a loved one has been seriously injured, disabled, or if a loved one was killed in a Washington crosswalk accident, you may be seeking answers to your legal questions from an experienced crosswalk accident attorney. The Farber Law Group, a Bellevue personal injury legal practice, may be of assistance to you.

Unfortunately, pedestrian vs. motor vehicle accidents occur more frequently than one might think and the young and the elderly are especially vulnerable. Many people assume that most of these accidents occur while people are jaywalking or running across the street where no crosswalk exists.

Crosswalk Accidents

Most people feel safe in a crosswalk, especially when they are walking in a clearly marked crosswalk with the stoplights in their favor. However, many pedestrians are injured or even killed while in a clearly marked crosswalk. Other crosswalk injuries are due to poorly maintained or planned sidewalks that cause slip and fall accidents.

If you or a loved one has been seriously injured, or if you have had a loved one killed in a crosswalk, The Farber Law Group would like to be of assistance to you.

Washington State Crosswalk Law

The Washington State legislature, in an effort to make crosswalks safe for bicyclists and pedestrians, drafted a statute governing crosswalks. RCW 46.61.235 requires drivers to stop and remain stopped to allow pedestrians and bicyclists to cross when the pedestrian or bicyclist is within one lane of the half of the roadway upon which the vehicle is traveling or turning. The statute makes no distinction between a marked and an unmarked crosswalk.

Causes of Crosswalk Accidents

The sad fact is that many pedestrian accidents occur when pedestrians are in clearly marked crosswalks. Common causes of crosswalk accidents include:

  • Drivers distraction caused by cell phone use, texting, eating, etc.

  • Drivers who are under influence of alcohol or drugs

  • Drivers who are speeding

  • Drivers who are passing a driver who is stopped to allow pedestrians to cross

  • Drivers who are reckless

  • Drivers who are too elderly to be driving

  • Drivers who are blinded by the sun

  • Drivers who do not see small children crossing the street

  • Semi-truck drivers who allow their trailer wheels to go onto a pedestrian walkway or sidewalk

  • Drivers who are making a turn without providing a proper lookout

  • Drivers attempting to beat a yellow light

  • Drivers who are jumping or running red lights
